I have been attempting Legal Service of Mario Lavandeira d/b/a Perezhilton.com, since filing a lawsuit in the Southern District of New York Federal Court on July 22, 2008.
I served him at EVERY address known, I even did a ‘nail and mail’ to his home address in LA. Yet, he continues to claim he has never been “properly” served.

He tried to evade personal service the last three times he was in NY, like when he appeared at the Howard Stern Interview or at the Martha Stewart Show. Out of respect for others, we had him at Citrine’s one night but did not serve him because we did not want to disturb our friendship with the owners and their PR people.
But at his own Halloween Party, that he promoted on the internet, sold tickets on the internet and where he charged up to $2,500 for the privilege of sitting with him at his VIP table, he was fair game. What is especially funny or pathetic is that he kept his own guests waiting for over 3 hours while he played at the Lucky Strike Bowling Alley down the street, before he made his entrance. Maybe he was hiding out - again - from us. Maybe he was hoping we would not be there. Maybe he was hoping it was past our bedtime.
Halloween night was the perfect time to end the charade.
We waited more then 4 hours and finally Margie went inside, at 12:37 am Mario was walking toward her and the DJ booth. She asked him his name and then ceremoniously placed the service papers on his chest, “Mario Lavandeira you have been served!”
